Public Foundation "Children Angels"
1.1. This public offer, hereinafter referred to as the "Offer", is a proposal from the Public Fund "Children Angels", hereinafter referred to as the "Public Fund", represented by the President of the Gints MA Foundation, acting in accordance with the Charter, to conclude with any person, responding to the Offer, a donation agreement, hereinafter referred to as the "Agreement", on the conditions provided for by the Offer. This offer is a public offer in accordance with Article 395 of the Civil Code of the Republic of Kazakhstan.
1.2. The offer comes into force the next day after it is posted on the website of the Public Association on the Internet at www.detiangeli.kz.
1.3. The offer is not limited and is valid until the day following the day the notice of cancellation of the Offer is posted on the website of the Public Fund. The Public Fund has the right to cancel the Offer at any time.
1.4. The public association is ready to conclude donation agreements in a different way and (or) on other terms different from those specified in the Offer, for which any interested person has the right to apply to the Public Association to conclude an appropriate agreement.
2. Subject of the contract
2.1. In accordance with this agreement, the donor, as a voluntary donation, transfers his own funds to the current account of the Public Fund in any way, and the Public Fund accepts this donation and uses it for statutory purposes. The fact of transferring the donation indicates the full agreement of the donor with the terms of this agreement.
2.2. The performance of the actions by the Donor under this agreement is a donation in accordance with Article 516 of the Civil Code of the Republic of Kazakhstan.
2.3. The donor donates funds to the Public Fund in the amount determined by the donor for the fund to provide charitable assistance in accordance with the statutory goals of the fund and current charitable programs. The donor can get information about the nature and amount of assistance needed for specific people, as well as charitable programs.
3. Public Fund activities
3.1. Collection of voluntary donations from individuals and legal entities to provide programmes aimed at providing medical equipment to hospitals and health centres.
3.2. Popularization of charity work.
3.3. The Social Fund is not engaged in commercial activities and is not intended for profit.
3.4. The Public Fund publishes information about its work and reports on the results of its activities on the website www.detiangeli.kz.
4. Donation
4.1. The donor is an organization or private person who provides donations or other resources on a non-commercial basis to the Public Fund.
4.2. Donor activity, that is, the provision of gratuitous assistance to a charitable foundation.
4.3. The donor independently determines the amount of the voluntary donation and makes it by transferring funds to the bank account of the Public Fund using any payment method specified on the website www.detiangeli.kz in accordance with the terms of this Agreement.
4.4. The donor can make a one-time donation through the bank according to the details, including the electronic payment system, by making a donation using a credit card or electronic money.
4.4.1. The fact that the donation was transferred to the account of the Public Fund, including by sending an SMS message within the framework of the projects, indicates the donor's full agreement with the terms of this agreement.
4.4.2. If the donor's chosen donation transfer method includes the definition of Purpose of Payment, the donor chooses to indicate one of the following:
- Donation for statutory activities. Not subject to VAT;
- Donation for current programs. Not subject to VAT.
4.4.3. When transferring a donation, for the correct identification of the payer, the Donor indicates his contacts: e-mail address and / or phone number.
4.4.4. The date of acceptance of the Offer and, accordingly, the date of conclusion of the Agreement is: the date of receipt of funds from the Donor to the current account of the Public Fund or, depending on the case, to the account of the Public Fund in the payment system; as well as the date of sending a short text message (SMS) or the date when the authorized representatives of the fund received funds from the box (box) for collecting donations.
5. Rights and obligations of the parties
5.1. The public fund is obliged to use the funds received from the Donor under this agreement, strictly in accordance with the current legislation of the Republic of Kazakhstan and within the framework of its statutory activities.
5.2. The donor has the right, at his discretion, to choose the object of assistance, indicating the appropriate purpose of payment when transferring the donation. The current list of projects is published on the website www.detiangeli.kz, in social networks and the media.
5.3. Upon receipt of an unaddressed donation, the Public Fund independently determines its use, based on the approved budget items, which are an integral part of its activities.
5.4. After receiving the donation, indicating the name and surname of the person in need, the Public Fund sends the donation to help this project. If the amount of donations for a specific project exceeds the amount required to provide assistance, the Public Fund informs donors about this by publishing information on the website. The public fund uses the positive difference between the amount of donations received and the amount required to provide assistance for a specific project for statutory purposes (for social support and protection of citizens, the implementation of international projects and programs, including charitable ones) based on common interests aimed at social support and protection of citizens in accordance with the Law of the Republic of Kazakhstan dated January 16, 2001 No. 142-II "On non-commercial organizations"). A donor who does not agree with the change in the purpose of funding has the right to demand a refund in writing within 14 calendar days after the publication of this information.
5.5. Donations received without specifying a specific goal are used to achieve the statutory goals of the Fund (rendering assistance to people with disabilities, placement in boarding schools, the purchase of rehabilitation equipment, the development of social and medical programs, administrative costs of the Fund in accordance with the Law of the Republic of Kazakhstan dated January 16, 2001 year № 142-II "On non-profit organizations").
5.6. The Donor agrees that the Public Fund will process the personal data provided by the Donor during the voluntary donation (name, address, place of residence, email address, bank details), including to third parties (based on an agreement with), in order to fulfill this agreements, including the following actions: collection, registration, systematization, accumulation, storage, clarification (update, change), extraction, use, transfer (distribution, provision, access), depersonalization, blocking e-mail, deletion, destruction of personal data. In all other cases, the Public Association undertakes not to disclose the Donor's personal information to third parties without his written consent.
An exception is the requirement for this information from government agencies authorized to request such information.
Consent to the processing of personal data is valid until the Donor takes it in writing.
5.7. The donor has the right to receive information about the use of the donation. To exercise this right: at the request of the donor, the Public Fund is ready: to confirm the intended use of the donations received by appropriate accounting documents; provide the donor with information about the assistance in the framework of the current project, as well as the responsible medical workers on the results of the assistance provided in the form of an extract from the medical history.
Documents, including medical and other materials, on the basis of which decisions on the provision of targeted assistance are made, are stored in the archive of the Public Fund.
5.8. The Fund does not bear any other obligations to the Donor, except for the obligations specified in this Agreement.
6. Other conditions
6.1. In the event of disputes and disagreements between the Parties under this agreement, they will be resolved, if possible, through negotiations. If it is impossible to resolve the dispute through negotiations, disputes and disagreements can be resolved in accordance with the current legislation of the Republic of Kazakhstan in the courts at the location of the Public Fund.
7. Information about the Public Fund
A public fund is a legal entity created and operating in accordance with the legislation of the Republic of Kazakhstan.
